Studies

Study for the presence of identity and similarity with earlier trademarks / geographical indications, operating on the territory of the Republic of Bulgaria.

Provides information on the existence of identical or similar trademarks / geographical indications, applied for or registered for identical and / or similar goods and / or services, valid on the territory of the Republic of Bulgaria - applied for or registered under national order, the Madrid Agreement and the Protocol to it and in accordance with Regulation (EU) № 2017/1001 of the European Parliament and of the Council of 14 June 2017 on the European Union trade mark. The purpose of the study is to provide trademark applicants with information on available earlier rights in order to prevent infringements of those rights. This type of research is also carried out for monitoring purposes, making it easier for trademark owners to monitor for infringements of their rights.  The subscription study provides the owners of registered trademarks with information about submitted new similar and / or identical applications, which are applied for or registered for identical or similar goods and / or services and operate on the territory of the Republic of Bulgaria. Users receive four studies within a year (at the end of each quarter) based on data provided by them. The one-year execution period starts from the date on which the paid fee is received.

Study for identity and / or similarity with earlier marks and geographical indications in foreign databases

    Study for identity and similarity with earlier marks / geographical indications effective in a given country.

    Provides information on the existence of identical or similar marks effective in the territory of that country, applied for or registered under national law, under the Madrid Agreement and its Protocol and under Regulation (EU) № 2017/1001 of the European Parliament and of the Council of 14 June 2017 on the European Union trade mark, in case that country is a member of the EU. The study under the national procedure is performed only for countries that provide free, open access to their databases.

      Study on the existence of identity and similarity with earlier marks / geographical indications under the Madrid Agreement and its Protocol for a Member State.

      Provides information on the existence of identical or similar marks / geographical indications valid in the territory of a Member State of the Madrid Agreement and its Protocol, applied for or registered under the Madrid Agreement and its Protocol.

      The cost of the identity and similarity studies with earlier marks / geographical indications is determined depending on whether the mark is verbal or combined, whether the client wishes the study to be carried out in five or ten working days and for how many classes of the International classification of goods and services wishes to be performed.

        Study by name of applicant / holder

        Provides information on whether a specific natural or legal person is an applicant / holder of trademarks and geographical indications applied for and / or registered under national law, under the Madrid Agreement and its Protocol and under Regulation (EU) № 2017/1001 of the European Parliament and of the Council of 14 June 2017 on the European Union trade mark.

          Study by application number or protection document

          Information is provided for the applied or registered trademark / geographical indication by a given number. A copy of the bibliographic reference is attached.

            Study on the legal status.

            Up-to-date information on the legal status of a specific trademark / geographical indication is provided, including all changes and entries in the State Register (changes in the name / address of the owner, transfer of rights, entry of licenses, special pledges and other entries). The study is carried out only for trademarks applied for or registered under national order and for international trademarks under the Madrid Agreement and its Protocol, for which the Republic of Bulgaria is a designated party.

            Issuance of certificates

            A certificate of the legal status of a trademark is issued to a person named in the application in order to serve before a certain institution.

            Issuance of priority certificates

            A priority trade mark certificate shall be drawn up, necessary to serve rightholders before various institutions in the exercise of convention priority.
