The right to apply belongs to the person who created the topology. Where the right of application belongs to several persons, it shall be exercised jointly by them. The refusal of one or more of the persons to participate in the application is not an obstacle for the others. The waiver shall be made in writing.
When the topology is officiary according to art. 12, para. 1, the right of application belongs to the employer or to the ordering party.
The right to apply when the topology is officiary passes to the person who created the topology, if within three months from the written notification of the created topology the employer, respectively the ordering party, does not submit an application, unless otherwise agreed between them.
The right to apply may belong jointly to the employer, respectively to the ordering party, and the person who created the topology, if this has been agreed..
The applicant shall be deemed to have the right to apply until otherwise established in court.
