The application for trademark registration is filed with the Patent Office of the Republic of Bulgaria, in one copy, on the letterhead of the Office, by mail, through the Portal for electronic services of the Patent Office or by transmitting a facsimile. When submitting an application by sending a facsimile within 1 month, it is necessary to present the original of the application.
The applicant must determine for which class (s) of goods / services he wishes to register his mark and indicate them in the field provided for that purpose in the application. The number of the International Classification of Goods and Services for the Registration of Marks (Nice Classification) alone is not sufficient. It is necessary to write the full list. From the number of the indicated classes in the application the fee is determined, which for application and expertise up to three classes is BGN 520 / 265,87 EUR, and for each subsequent specified class - BGN 30 / 15,34 EUR. The applicant is given a 14-day period for their payment. Up to 14 days after the expiration of the provided term, the fees can be paid in double amount.
The applicant can be any Bulgarian natural or legal person. Applicants can be more than one.
After payment of the fee for application and expertise, a formal expertise and expertise on the existence of absolute grounds for refusal is performed. Any application that meets the requirements for formal regularity and does not fall under the prohibitions of Article 11 of the Trademarks and Geographical Indications Act (TGIA) shall be published in the Official Bulletin of the Patent Office. The applicant shall be notified in writing of the publication. Within three months from the date of publication of the application, any person may file an objection to the registration of the mark or opposition. After the expiry of the opposition period and where no opposition has been filed or the opposition has been rejected in whole or in part, a decision on the registration of the trademark shall be sent to the applicant. The trademark is entered in the State Register of Trademarks and published in the official bulletin of the Patent Office. The applicant will receive a certificate of registration of the mark within 14 days after payment of a fee of BGN 50 / 25.56 EUR, according to Art. 4, para. 1, item 6 of the Tariff of Fees. If the applicant pays by bank transfer, he should present in the PO a document for the ordered bank transfer. The certificate may be obtained after the expiration of the above term in the Registry of the Patent Office of the Republic of Bulgaria or by mail, upon submission of a written request.
You can pay the due fees at the cash desk in the Registry of the Office, by bank transfer, by standard bank transfer, as well as by electronic banking. The bank account is indicated on the website of the Office.
The issuance of a duplicate is part of the administrative services provided by the Patent Office and is subject to the internal rules for the organization of administrative services. The request is submitted in free form by the trademark owner, and a fee of BGN 40 / 20.45 EUR is paid.
The validity of the trademark registration is ten years from the date of filing the application. The registration may be renewed indefinitely for further periods of ten years. Renewal is made upon submission of a request by the holder, accompanied by a document for paid fee. The renewal fee until the expiration of the registration of up to three classes is BGN 300 / 153.38 EUR, for each subsequent class - BGN 50 / 25.56 EUR, and up to six months after the expiration of the registration of up to three classes - BGN 450 / 230.08 EUR and for each subsequent one BGN 80 / 40.90 EUR.
The change of name / address of the trademark owner is made after the submission of the respective request for change of name and address, and a fee of BGN 50 is paid. The owner is notified of the performed action.
The trademark owner may authorize its use by third parties for all or part of the goods or services for which it is registered, by submitting to the Office a request for registration of the assignment of the right to use a trademark to which the license applies. contract and document for paid fee of BGN 60 / 30.67 EUR. The Patent Office shall issue a certificate of registration. Trademark rights may be transferred for all or part of the goods or services for which it is registered. A certificate is issued to the new holder.
Radio and / or television broadcasts, as well as books, are subject to copyright and not to industrial property. Only their titles could be protected as trademarks, following the procedure already described above.
