The submission of a request for temporary protection or for effect of an European patent on the territory of the Republic of Bulgaria may be made directly, by mail or by fax. Where the submission is made by fax, the originals of the documents must be received at the Patent Office within one month of the date of the facsimile. The date of dispatch of the facsimile must be clearly indicated on the original documents sent
The request for temporary protection or effect of a European patent on the territory of the Republic of Bulgaria is submitted personally by the applicant / holder of the European patent or through a local industrial property representative.
Applicants / holders of European patents with a permanent address or with a registered office outside the country must submit the request through a local representative.
When the applicants / holders of European patents are more than one, one of which is a Bulgarian citizen or legal entity with registered office in Bulgaria, the request for temporary protection or for effect of a European patent on the territory of the Republic of Bulgaria is submitted at the choice of the applicants / holders - personally or through a local industrial property representative.
The annual patent fees for European patents with effect on the territory of the Republic of Bulgaria shall be paid to the Patent Office of the Republic of Bulgaria by the order of art. 33 of the APRUM for each patent year following the year in which the European Patent Office publishes the notice of the grant of the European patent.
The decisions of the European Patent Office in proceedings for annulment of a European patent, in which the Republic of Bulgaria is indicated, shall have effect on the territory of the Republic of Bulgaria.
The applicant for or owner of a European patent may at any time file a corrected translation by paying an appropriate publication fee. The Patent Office shall publish a notice of the corrected translation received in the Official Gazette.
Where the corrections relate to a translation of the patent claims in the European patent application, access to the corrected translation shall be provided at the same time as the notice in the bulletin,
Where the adjustments relate to the translation of the European patent, the patent shall be republished with the amendments introduced
