The EUIPO, under the European Cooperation Project ‘ECP3 Academy eLearning (ALP)’, has produced a set of tutorials reflecting national IP practices, in relation to trade mark opposition, trade mark cancellation and design cancellation.
The tutorials are available on the EUIPO Academy Learning Portal:
The set of tutorials covers 44 lessons prepared in close cooperation with 20 EU intellectual property offices, including the offices of Austria, Bulgaria, BENELUX, Czech Republic, Cyprus, Spain, France, Greece, Croatia, Hungary, Ireland, Italy, Lithuania , Latvia, Malta, Poland, Portugal, Romania, Sweden and Slovakia.
All training videos follow a similar structure. They use video animation to present a situation that could easily happen to an entrepreneur. The idea is to link real life cases with explanations of possible actions that can be taken in each one of the participating EU Member States.
In the tutorial on filing an opposition against a trademark application, the pastry shop owner discovered that another company had registered a trademark, similar to her own.
In the tutorial on cancelation of a trademark registration, the entrepreneur did not conduct a preliminary study and now finds that she uses a trademark, similar to the trademark of another company that had registered it, but did not used it for several years.
In the tutorial on deleting a design, furniture manufacturers face a problem with another company that they believe is violating their registered IP rights.
In the second part of the training videos, an expert from the relevant intellectual property office explains the necessary steps to be taken for solving the problem presented in the video.
The videos are available on the EUIPO Academy training portal as well as on the official websites of the participating offices.
